"Attached is the ordinance that was drafted specific to Webster County by an independent engineer. This ordinance was delivered via email to the Webster County Commission this morning, and has been forwarded for review to the Commission’s current counsel who is advising them on the data center issue moving forward.
I don’t think anyone should expect them to pass this word for word, but it’s up for review by their attorney for any edits or expansion, should it be adopted. This is just to help provide an example of what could be done for a Class 3 County.
I have confirmed that the commissioner’s legal advice is no longer coming from Carnahan & Evans – they have hired outside counsel that is more familiar with data centers to advise then moving forward. (I have it in my notes but as I type this, I am blanking on the name that was given, if you know you can provide that in the comments or via messenger.)
I was asked to share this document with the public by people at this evening’s town hall. After speaking with the Commissioners and getting an update, I am hopeful and will provide updates as I can."
